These Terms govern the website, mobile application, technology platforms, and 1.21 Gigawatts Charging Network. In Mexico, the relevant services are provided by 1.21 Gigawatts, S.A.P.I. de C.V., at Presidente Masaryk 29, 4th Floor, Col. Polanco, Postal Code 11560, Mexico City, Mexico. In the United States, the relevant services are provided, as applicable, by 1.21 Energy SD, LLC, at 8 The Green, Suite A, Dover, DE 19901-3618, United States. The entity responsible for a transaction will be identified at the station, in the app, on the invoice, or in the applicable agreement. Use of a common brand does not automatically make one entity responsible for another’s obligations. Contact: info@121gigawatts.net.
“Application” means the app, website, portal, software, or interfaces enabled by 1.21 Gigawatts. “Charging Network” includes owned, managed, affiliated, and roaming stations. “Station” means charging equipment and associated spaces; “Connector” is the compatible physical interface; “Charging Session” is the service from activation to termination; “User” is anyone accessing or purchasing services. “Price” includes properly disclosed charges for energy, time, activation, occupancy, or other applicable items. “Idle Fee” means a fee for remaining after charging ends or a grace period expires. “Operator” is the entity providing service at a station. “Account” is the user’s access profile.
By creating an Account, accepting these Terms through an available mechanism, or voluntarily using a service after the applicable terms are made available, the User agrees to comply with them. Starting a Charging Session authorizes the service and the prices disclosed beforehand. Where the law requires a separate affirmative consent, we will obtain it separately. Acceptance of these Terms alone is not consent to promotional SMS and does not replace the Privacy Notice. We may update these Terms and will display the revision date; material changes will be communicated as required by law and will not retroactively disadvantage sessions already underway.
The Charging Network supports finding stations, checking estimated availability, starting and stopping charging, monitoring sessions, managing payments, and, where offered, reservations, fleet programs, subscriptions, and roaming. Some infrastructure is owned or operated by third parties whose properly disclosed station-specific conditions may also apply. Continuous availability of any station, connector, power level, or service is not guaranteed. Features may vary by country, station, technology, and third-party arrangements.
Users represent that they have the legal capacity, or valid representative authorization, required to use the service; are authorized to use the vehicle and payment method; and will supply accurate, current information. Persons creating accounts for organizations represent that they have authority to do so. Minors must not handle electrical charging infrastructure without supervision by a competent adult.
Users must protect credentials, maintain current information, and report unauthorized access. We may verify mobile numbers or email through one-time codes, implement antifraud checks, and suspend access where necessary to protect accounts and infrastructure. Users must notify us when they lose control of a mobile line or change numbers. Accounts are personal except for expressly authorized fleet or business features.
Users must follow safety instructions, signs, and property rules; verify vehicle and connector compatibility; use authorized payment methods; move vehicles promptly when sessions finish; and avoid blocking chargers or access routes. They must report damage, malfunctions, or safety incidents. Users are responsible for direct damage they cause through intentional misconduct, negligence, or misuse, subject to applicable law.
Before connecting, Users must visually inspect cables and connectors and avoid equipment that is damaged, unsafely wet, smoking, sparking, or emitting a burning smell. Opening, modifying, forcing, or repairing equipment; bypassing safety controls; using unauthorized extensions; or energizing incompatible equipment is prohibited. In an emergency, stop the session if safe, move away, and contact emergency services and support. Additional safety rules appear in Appendix A.
Users must select the proper connector and use vehicles and accessories approved by their manufacturers. Available standards may include NACS, CCS1, CHAdeMO, GB/T, or others shown at each station. Charging speed, duration, and final state of charge depend on vehicle configuration, battery management systems, temperature, battery condition, infrastructure, site load, and power supply. Advertised rated power does not guarantee actual delivered power or driving range.
Fraudulent use; impersonation; interference with software, networks, security systems, or meters; unauthorized scraping; resale without agreement; physical tampering; use of incompatible connectors; blocking access; and unlawful or unsafe activities are prohibited. We may suspend sessions or accounts for justified safety, compliance, or fraud-prevention reasons, subject to law.
Sessions may be started through the Application, QR code, RFID, roaming, or other supported methods. They may end by User action, disconnection, configured limit, vehicle action, electrical or communication failure, or emergency. Electronic records from stations, management systems, and payment processors may serve as reviewable evidence of energy, time, and fees, without limiting a User’s right to dispute them. Interrupted or partially completed sessions will be evaluated based on services actually provided and applicable law.
Applicable prices will be disclosed before a session begins through the Application, station display, or another available channel. Where permitted and properly disclosed, charges may include per-kWh, per-minute, activation, connection time, parking or Idle Fees, reservation, membership, roaming, and taxes. Prices may vary by station, time, demand, country, program, or agreement. Price changes do not alter terms of an already-started session. Promotions are subject to disclosed specific conditions.
By adding an authorized payment method and requesting a session, Users authorize applicable preauthorizations, verification, and charges for services actually used and properly disclosed fees. Payments and full card details are handled by external payment processors; 1.21 Gigawatts does not directly store full card numbers or card security codes. Charges may settle after a session; temporary bank holds and disputes may apply and are subject to review. Promotional credits or wallets, where offered, are governed by their stated rules and applicable law.
Users may request a review or refund at info@121gigawatts.net, providing the date, station, account, amount, and issue. We will review session telemetry, payment records, and relevant evidence. Billing errors, undelivered services, or improper amounts will be corrected or refunded where warranted; processing times may depend on financial institutions. Refunds will follow applicable law and will not be unilaterally replaced with credits where a monetary refund is required. Invoices will be provided in accordance with applicable tax rules.
Users may request account closure through support, subject to reasonable verification and outstanding obligations. We may restrict or suspend access for fraud, unsafe use, material breach, security issues, or legitimate unpaid amounts, providing notice where legally required. Termination does not cancel accrued amounts, valid claims, or legally required records. Privacy requests are governed by the Privacy Notice.
We use commercially reasonable efforts to deliver safe and functional services. Nevertheless, energy supply, connectivity, station availability, charging speed, and compatibility may depend on factors outside our control. To the extent permitted by law, services are provided as available, without guarantees of driving range, minimum charging time, or permanent access to a specific location. Nothing excludes consumer warranties or rights that cannot lawfully be waived.
Our collection and use of personal data are described in the Privacy Notice at www.121gw.net, including account, location, vehicle, charging, billing, technical, and SMS data. The Notice identifies the responsible entity by country and available privacy rights and request procedures. Marketing or promotional SMS consent is obtained separately where required; using the network or accepting these Terms does not by itself authorize promotional texts.
Network trademarks, interfaces, designs, text, databases, software, and content belong to 1.21 Gigawatts or their respective owners. Users receive a personal, limited, nonexclusive, revocable, nontransferable license to use the Application for the services. Unauthorized commercial copying, reverse engineering, misuse of marks, and mass extraction of information are prohibited, subject to statutory rights.
Charging spaces may be located on third-party property and subject to operating hours, access controls, property rules, and parking charges separate from charging. Users must vacate a space when charging ends and observe any disclosed grace period. Idle Fees apply only when their existence and calculation are properly disclosed before use and permitted by law. Additional terms appear in Appendix B.
To the fullest extent allowed by law, we are not liable for indirect loss, lost profits, or service interruptions caused by third parties, vehicle conditions, telecommunications failures, energy supply, or force majeure outside our reasonable control. Contractual liability for a particular session may be limited to the amount paid for the service giving rise to the claim only where such a limitation is legally valid. Nothing excludes liability for intentional misconduct, gross negligence, personal injury, property damage, or other liability that cannot lawfully be limited, or diminishes mandatory consumer rights. Users are responsible for damage caused by their misuse to the extent permitted by law.
Vehicle manufacturers determine compatibility, charging conditions, and battery performance. Users must follow vehicle manuals and alerts and verify that any adapters are manufacturer-approved. We do not guarantee the pre-existing condition or behavior of batteries or accessories outside our control. Claims concerning alleged station-caused failures will be evaluated under applicable law and technical evidence without advance waiver of rights.
Service may be affected by power outages, grid constraints, maintenance, cellular or internet failures, external platform issues, weather, accidents, and government actions. We may take equipment offline for maintenance, repairs, safety, or compliance. We will communicate significant outages when reasonably practicable. Charges and refunds will be assessed based on service actually received and legal obligations; not every failed session necessarily constitutes operator fault.
Unless a specific agreement or law provides otherwise, purchasing a Charging Session does not transfer renewable energy certificates, carbon credits, avoided-emissions attributes, or similar rights associated with infrastructure, generation, or environmental programs. Attributes lawfully owned by the operator or infrastructure owner may be registered, reported, transferred, or monetized under applicable agreements and rules. Environmental reports provided to Users are informational unless otherwise agreed in writing.
We may offer coupons, discounts, promotional credits, fleet plans, reservations, memberships, or rewards with specific eligibility, duration, and availability conditions. Restrictions and pricing will be disclosed before purchase. Unless required by law or stated terms, promotional credits are not redeemable for cash, transferable, or interest bearing. Earned benefits will not be retroactively modified where prohibited by law.
We may use email, push notifications, in-app messages, and, with applicable authorization, SMS or similar messaging for service, security, and support communications. Users must keep contact details current. Delivery depends on third-party networks and may not be instantaneous. Consent to automated calls or promotional texts is not presumed from merely providing a number and will be obtained separately where legally required.
Services provided in Mexico by 1.21 Gigawatts, S.A.P.I. de C.V. are governed by applicable Mexican law and the competent judicial and consumer-protection mechanisms, without waiver of non-waivable rights. Services provided in the United States by 1.21 Energy SD, LLC are governed by the relevant federal and state laws based on the service and User location, preserving mandatory venue and consumer-protection rules. Any forum selection must be supported by a valid agreement and applicable law; exclusive Mexico City jurisdiction is not imposed on U.S. users.
Questions and complaints may be sent to info@121gigawatts.net, and we will seek good-faith resolution. In Mexico, consumers retain applicable rights and complaints procedures under the Federal Consumer Protection Law, including access to PROFECO as appropriate. In the United States, users retain applicable statutory, administrative, and regulatory remedies. Nothing requires advance waiver of non-waivable protections or legally available administrative remedies.
If any provision is unenforceable, the remainder will remain effective to the extent possible. Failure to enforce a right is not a waiver. Specific fleet, property-owner, operator, and third-party station conditions may supplement these Terms but must be disclosed when applicable. In case of conflict, valid service-specific terms and mandatory consumer protections control. Spanish and English versions are provided for accessibility and are interpreted consistently with the law governing each operation.
These Terms take effect on October 27, 2026 and remain in effect until replaced or updated through applicable procedures. Obligations concerning accrued payments, claims, data protection, intellectual property, safety, and dispute resolution survive account termination where their nature or applicable law requires.
