1.21 Gigawatts is the brand used for electric vehicle charging services and related solutions. For services provided in Mexico, the data controller is 1.21 Gigawatts, S.A.P.I. de C.V., at Presidente Masaryk 29, 4th Floor, Col. Polanco, Postal Code 11560, Mexico City, Mexico. For services provided in the United States, the responsible entity is 1.21 Energy SD, LLC, at 8 The Green, Suite A, Dover, DE 19901-3618, United States. The entity responsible for a particular service will be identified through the relevant transaction, station, invoice, agreement, or communication channel. Both entities may cooperate in administering services, consistent with their roles and applicable law.

This Notice covers personal information processed through www.121gw.net, mobile applications branded 1.21 Gigawatts, their supporting technologies (including the Driivz charging-management platform where applicable), charging stations and networks, individual and fleet services, contact forms, payments, commercial activities, customer support, and electronic communications, including SMS. Certain third-party stations or integrations may provide additional notices where applicable.
Depending on the service, we may process: (a) identity and contact details, such as name, email, mobile number, company, and representative details; (b) account and authentication data, such as user IDs, preferences, access logs, and temporary verification codes; (c) vehicle and charging data, such as vehicle type, station and connector used, dates, duration, delivered energy, pricing, and charging history; (d) billing and transaction details, such as tax information, amounts, references, receipts, and payment status; (e) technical information, such as IP addresses, device identifiers, diagnostics, security logs, cookies, and platform activity; (f) approximate or precise location when users enable location permissions or features; and (g) communications and preferences, support messages, and records of SMS consent and opt-outs, including dates, sources, and status.
Payment card data are handled by an external payment processor; we do not directly store full card numbers or card security codes. We do not ordinarily request sensitive personal information. If its processing becomes necessary, we will give the required notice and obtain any legally required consent.
We use information to create and administer accounts; authenticate users and send requested verification codes; locate stations and provide charging sessions; calculate consumption, prices, payments, and refunds; issue invoices and maintain tax records; provide support and resolve incidents and disputes; send authorized operational messages about accounts, charging, payments, or security; administer fleet and partner arrangements; detect fraud, misuse, and cybersecurity incidents; maintain and improve the reliability and security of platforms and chargers; compile operational statistics; and fulfill legal, regulatory, and contractual obligations. Some activities are necessary to provide a requested service or meet an obligation; others rely on the authorization or legal basis required by applicable law.
Where appropriately authorized or otherwise permitted by law, we may use contact details and preferences to send promotions, discounts, notices of new locations, loyalty programs, commercial updates, and surveys, and to analyze commercial trends and improve user experience. In Mexico, these are secondary purposes that may be declined without preventing essential services. Consent to promotional SMS is optional, separate from consent to service messages, and is not a condition of purchasing or using a charging session. To object to secondary purposes, email info@121gigawatts.net; to opt out of SMS, reply STOP to the sending number.
Our SMS programs include: (i) user-requested verification or authentication messages, generally one message per request; (ii) authorized operational alerts about accounts, charging, payments, support, and security, with variable frequency; and (iii) promotional offers, sent only with valid marketing consent, with variable frequency. Consent is collected through the application or other authorized channels, recorded by category when applicable, and may be withdrawn as provided by law.
Message and data rates may apply. Reply STOP to opt out of the applicable messaging program and HELP for assistance, or email info@121gigawatts.net. Where message types cannot technically be separated within the same number or program, an opt-out may affect all SMS sent from that number or program. Mobile carriers may delay or fail to deliver messages.
We DO NOT sell mobile phone numbers, personal information associated with SMS campaigns, or text messaging opt-in and consent data. No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from all categories of information shared for those purposes and will not be shared with third parties for independent use.
Messaging providers acting on our behalf, including Vonage and relevant application technology providers, may process strictly necessary information to deliver messages, maintain records, honor opt-outs, and comply with rules, without using it for independent marketing. Disclosures legally required or necessary to operate the service are distinct from the prohibited sale or commercial sharing described above.
We may use hosting providers, application developers, charging-network management providers, Driivz where applicable, payment processors, Vonage or other SMS providers, email services, analytics, security, support, accounting, and billing providers. We may also disclose information necessary to station operators, roaming or fleet partners to provide a requested session, resolve an incident, or fulfill an agreement; to group entities according to their roles; and to authorities where legally required. We apply applicable agreements, safeguards, and consent requirements. These service-related disclosures do not authorize recipients to use SMS consent data for their own advertising.
Because our operations involve Mexico and the United States and external technology infrastructure, data may be stored or processed outside the country where collected. Transfers to parties other than processors will be subject to applicable notice, safeguards, and consent, unless a legal exception applies. We retain data for as long as necessary for the stated purposes and any applicable tax, accounting, contractual, regulatory, fraud-prevention, or claims-defense requirements. We then delete, anonymize, or restrict data as appropriate. We use reasonable physical, administrative, and technical safeguards to protect information, limit access, and reduce risks of loss, alteration, or misuse. No system is infallible; we provide incident notices where legally required.
In Mexico, individuals may exercise Access, Rectification, Cancellation, and Opposition (ARCO) rights, withdraw consent, and restrict uses or disclosures as provided by law. Email info@121gigawatts.net with: your name and reply contact; documentation reasonably verifying identity or representation; the requested right and a clear description of the information involved; and details that help locate it. We may request additional information only as legally necessary.
We will communicate our ARCO decision within 20 business days after receiving a request and, where granted, implement it within the following 15 business days after notifying our decision, subject to legally permitted extensions or exceptions. Deletion or withdrawal does not prevent retention that the law requires.
Where applicable U.S. federal or state law provides rights to know, access, correct, delete, obtain, restrict, or opt out of certain processing, individuals may submit requests to info@121gigawatts.net. We will verify identity and respond within applicable deadlines, subject to legal exceptions. We will not unlawfully discriminate against individuals for exercising privacy rights. We do not represent that any particular state privacy law applies to every operation; rights depend on the relevant facts and statutory thresholds.
The website and applications may use cookies, identifiers, and analytics tools for functionality, security, traffic measurement, and improvements. Users can control certain cookies through their browser or available preference tools where appropriate. Location-based functions are subject to device permissions; disabling them may limit nearby station searches. Any analytics or advertising tools used will remain subject to applicable notice and consent requirements.
Our contracting and payment services are directed to persons legally able to use them. We do not knowingly seek to collect children’s personal information without required authorization. If you believe a minor improperly provided information, contact info@121gigawatts.net.
We will publish updates to this Notice at www.121gw.net with a revised date. Where a change requires additional notice or renewed consent, we will follow applicable legal procedures.
